BitGo CEO Mike Belshe warned at Korea Blockchain Week that the U.S. digital asset market remains exposed to systemic risks following the Senate's failure to advance the Digital Asset Market Clarity Act. The Senate rejected a motion to proceed on Sept. 15, with 49 votes in favor and 50 against—falling short of the 60 required. Belshe argued that integrating exchange, brokerage, and custody functions within a single firm creates acute concentration risk.
Belshe identified custody risk as the primary structural vulnerability. Digital assets function as bearer instruments controlled by private keys. A failure at an institution performing both critical trading and custody operations could simultaneously impair customer assets and market infrastructure—a single point of failure with cascading contagion potential.
The second concern is counterparty credit risk. Belshe drew an explicit parallel to Lehman Brothers' 2008 collapse, arguing the consequences would be more disruptive if a failed institution simultaneously operated as an exchange, clearing house, and custodian. Separating these functions creates natural checkpoints; integrating them eliminates them.
BitGo's model emphasizes custody infrastructure and self-custody trading connections, contrasting with the integrated platforms Belshe identified as problematic. He stressed this is a structural risk assessment, not a claim that systemic failure has occurred.
Belshe said BitGo can operate without the legislation, but banks and traditional financial firms may approach digital assets more cautiously without regulatory clarity. The absence of defined market structure leaves ambiguity over how risks should be allocated across intermediaries.
The Clarity Act aimed to separate jurisdictional responsibility—designating which digital assets fall under SEC oversight (securities) versus CFTC jurisdiction (commodities). Its failure leaves market participants without statutory clarity on separation of functions, a gap Belshe views as material to systemic stability as digital markets scale.
